Terms of Service
Defines the rights and obligations between the member and the Operator for using the Medifact service.
Art 1. Purpose
The purpose of these Terms of Service is to define the conditions, procedures, rights, obligations, and responsibilities between Medifact (hereinafter referred to as the "Operator") and members using the AI-based medical fact-checking and academic literature cross-reference verification web platform 'Medifact' (hereinafter referred to as the "Service").
Art 2. Definitions
The terms used in these Terms shall have the following definitions:
- Service: Refers to the medical claim text/URL fact-checking, PubMed matching, credit subtraction, and dashboard reporting features provided by the Operator through the website.
- Member: Refers to a user who agrees to these Terms, signs up, and uses the Service. Members are classified as:
- Member: A general account holder who receives credit recharge and personal verification history management.
- MD Specialist: A verified medical license holder who has authority to add professional opinions to AI analysis reports.
- Admin: The system administrator designated by the Operator to oversee overall system monitoring, billing, and credit adjustments.
- Credit: Refers to the platform-exclusive ticket consumed to execute the fact-checking engine analysis.
Art 3. Effectiveness and Modification of Terms
1. These Terms become effective when the Operator posts them on the service screen or notifies members by other means.
2. The Operator may amend these Terms. If amended, the Operator will notify the effective date and reasons for the amendment on the service screen 7 days prior to the effective date (30 days prior if changes are disadvantageous to members).
3. If a member does not agree to the amended Terms, they may request account withdrawal. Continuous use after the effective date constitutes consent to the changes.
Art 4. Formation of Contract and Registration
1. The contract is established when the applicant agrees to these Terms and the Privacy Policy, submits a signup application, and the Operator accepts it.
2. Members must provide accurate email and information. The Operator is not liable for issues arising from using another's email address or providing false information.
3. The Operator may refuse acceptance or terminate access if malicious usage (e.g., bot API spamming) is suspected.
Art 5. Copyright and Usage Restrictions
1. Copyrights and other intellectual property rights for the fact-checking reports, scoring logic, and summaries generated by Medifact belong to the Operator.
2. Members may share fact-check results for educational or reference purposes. However, using the results for commercial promotion (e.g., distorting reports to sell supplements) without consent is strictly prohibited.
3. Review comments, ratings, and edits submitted by medical experts (MDs) are treated as contributions for public benefit. Even if an MD member withdraws, these contributions will not be deleted to maintain service integrity; instead, they will remain on the site in an anonymized format with their masked name and specialty (e.g., "Dr. H*ng (Family Medicine - Retired)").
⚠️ [Copyright and Source Attribution]
When citing fact-check results on external blogs, news, or papers, you must clearly state **"Source: Medifact (medifact.today)"** and include the link to the original report page.
Art 6. Service Provision and Limits
1. The Service is provided 24 hours a day, 365 days a year, but may be suspended temporarily for system maintenance or external API failures with prior notification.
2. Guests cannot run fact-checks after reaching the daily free trial limit (3 times).
3. The Operator may reclaim credits or ban accounts if fraudulent credit acquisition or exploitation is detected.
Art 7. Obligations of the Operator
1. The Operator complies with relevant laws and these Terms, and maintains secure systems to provide stable services.
2. The Operator guarantees safe, neutral handling of fact-check inputs, isolating Personally Identifiable Information (PII) before calling external AI cloud infrastructure APIs.
Art 8. Obligations of Members
1. Members must comply with all rules and must not load the server infrastructure with abnormal/bot traffic.
2. Members must keep passwords secure. The Operator is not liable for credits consumed due to third-party access resulting from poor password management.
Art 9. Contract Termination and Suspension
1. Members can request account withdrawal through the settings menu at any time.
2. Upon account withdrawal, all remaining credits held by the member are permanently forfeited and are non-refundable and non-recoverable.
3. To prevent abuse and fraudulent reuse of credits, withdrawn members cannot re-register with the same email account for 30 days after the withdrawal date.
4. The Operator may suspend access immediately if fraudulent payments, credit hacking attempts, or identity theft are detected.
Art 10. Medical Disclaimer
💡 Legal Disclaimer
1. All fact-checking scores, AI analysis reports, and cross-reference details provided via Medifact are purely comparative data against academic journals and literature abstracts.
2. This analysis is NOT a tool designed for, and CANNOT replace, professional medical decisions, diagnoses, prescriptions, surgical guides, or medication advice by licensed physicians.
3. The Operator does not legally guarantee the absolute correctness of AI results, and is NOT liable for any medical choice, health issue, or legal dispute resulting from reliance on the report. Always consult a qualified physician for face-to-face medical advice.
Art 11. Indemnity
1. The Operator is exempt from liability if services cannot be provided temporarily due to force majeure, DDoS attacks, network ISP failures, or backend AI cloud infrastructure global downtime.
2. The Operator is not responsible for typos or errors in the user's input that lead to degraded report reliability.
Art 12. Jurisdiction
Any legal disputes arising between the Operator and members regarding service usage shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's headquarters.
